Terms of Service
General
The following Terms and Conditions govern your rights and obligations with OMS Hosting, and those of OMS Hosting in relation to the Services offered by OMS Hosting. By registering with OMS Hosting, and/or using the Web Site you agree to these Terms and Conditions.
Definitions
- "User" refers to any person(s) using the Web Site or registering with OMS Hosting.
- "Services" means the services, offered by OMS Hosting
Email
OMS Hosting reserves the right to email the User regarding any key aspects of service, and will presume that the emails will have been read. It is the User's responsibility to ensure their registered email is valid.
The User accepts that OMS Hosting is not at fault if the User does not read any emails sent by OMS Hosting to their registered email address, and therefore the User is unaware of any change of service or the like.
Web Site Changes and Service
Changes to the OMS Hosting Website and Services It is accepted by the User that OMS Hosting may alter any aspect of the Web Site, and the Services provided without due notification to the User. The User will have no claim of breach of contract or otherwise in relation to any such alteration.OMS Hosting reserve the right to monitor their Services for abuse, and the User agrees to comply with any such monitoring.
Privacy
OMS Hosting will not sell or pass on any private or personal information and details given by the User to any Third party organization, unless with the permission or request of the User. OMS Hosting reserves the right to use the information supplied by the User to develop general statistics. This will be a general survey, and not detail any specific User. OMS Hosting reserves the right to publish any Statistics connected to their Services. The information published may be derived from server logs or any other Means necessary. However, this will not contain any private information from our databases.
User Conduct
The User agrees and accepts that in using any of the Services, Web Site or any other aspect of service relating to OMS Hosting, it shall:
- Use the Web Site only for purposes abiding to the law, and in a way that does not restrict, infringe or inhibit the Rights or use of the Web Site by any other User or third party.
- Not act in a manner that is unlawful, or harass, upset, distress, or cause any inconvenience to any other person
- Not act is a manner that degrades, satirizes, or negatively impacts OMS Hosting in the Internet community.
- Not upload, transmit, display distribute or post links to, or in part or full, any information or material of which they do not own copyright or have permission for, any material which is illegal or harmful, abusive, racist or ethnically Objectionable, pornographic or obscene, disturbing, threatening, upsetting, distressing or any of the like.
- Not upload, divulge, distribute, post or transmit any information, which can cause or contains a computer virus, or any other form of code or file that will affect the use of the Web Site or any other User in any way.
- Not send, or assist in the sending, of any unsolicited emails, documents or the like, or any form of action that will affect the Web Site, Users or Services of OMS Hosting
- Act with respect to other Users of OMS Hosting Services and the Web Site. Abuse, maliciousness, racism, prejudice, or any Of these like activity ,that can cause any distress, upset or discomfort to any person will not be tolerate.
A User will not be limited to one of the above.
One or more of the OMS Hosting Admin will decide the action taken by OMS Hosting regarding any non-complying User, And will be decided on a case-by-case basis.
When possible OMS Hosting will notify the User of predicted downtime and/or scheduled downtime for upgrades, updates And the like. Copyright and other intellectual property rights
The User accepts that all copyrights, trademarks, design rights and other intellectual property rights, (either registered or unregistered) belong to OMS Hosting, and the User agrees not to infringe any of these rights. No copying, distributing, modification or the like, of the Website and material is permitted. No resale or supply of any material is permitted.
The User accepts that some material may be supplied under license to OMS Hosting, and therefore the intellectual property rights in such cases belong to the licensor.
The User agrees not to upload, display, post or the like, any material of which they do not own the intellectual property rights. The User agrees to absolve OMS Hosting of any responsibility, cost, losses, and damages or expenses arising from any posted, displayed or uploaded material of which infringes the intellectual property rights of any third party, including, but not limited to, any claims that are made.
Discontinuing of Services
OMS Hosting has the rights to discontinue services or deny access to anyone who violates our Terms and Conditions shown below WITHOUT WARNING OR PRIOR NOTICE. Received amount will not be refundable if your account termination is due to violation of any of terms and conditions outlined below:
- If anyone of our clients mis-utilizes the allotted server space, then we will reduce the space given to him or her.
- If any client gives email ids free of cost to any other person, who is not related to the website owner or his or her company, then we will decrease the number of email ids.
- If allotted email id space is misused, then we will diminish the space per email id.
- If bandwidth will be mis-utilized by the client, then we will make smaller the given bandwidth.
- According to Indian or International IT Act, if any thing is going on illegal inside the website, then we will suspend customer account.
- If any client tries to intentionally hamper (Hacking or sending virus) our server in any ways, then also we will suspend his or her account.
Abuse of SMTP Mail Server
We do not allow our clients to send more than 2000 of e-mail IDs per day from a hosting account.
Network security
If anything will happen to our network security, then also we will take immediate action against the respective hosting account.
Spam
Unsolicited commercial advertisements (spam) are not allowed in e-mail id and will likely result in account cancellation.
Abuse of Traffic
If any customer who violates Policies in abusing site transfer, then we will decrease his Traffic quota allotted.
Abuse Space
OMS Hosting will not tolerate if any client abusing the disk usage. At least 90% of your web pages (html) must be Linked with files (.GIF, .JPEG, etc.) stored in our server.
Web sites those are found containing no html documents or a large number of unlinked files are subjected to deletion of files or account cancellation with or without prior notice.
Customers can not run IRC, bots or clients on servers.
Customers can not run Bulk Emailing, Unsolicited Emailing, Newsgroup Spamming, Pornographic Content, Illegal Content, Copyright Infringement, Trademark Infringement, Warez, Cracks, and Software Serial Numbers etc.
Disclaimer
The User accepts that OMS Hosting , its employees, managers, and representatives of any kind cannot be held responsible or be liable for any damages, costs, loss or expenses arising either directly or indirectly from the User downloading any of the content of the Website or using any of the Services, including but not limited to claims thereof.
Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Indian Cyber Law. Any disputes arising from here will be exclusively subject to the jurisdiction of the Indian courts.
Acceptance of Terms
By using any of the Services provided by OMS Hosting, either by registering or anonymously, the User agrees to be bound by these terms and conditions. Failure to comply will result in the User not having permission to use these Services, and they should no longer partake in doing so.
Payment and renewal of Hosting Services
For using OMS Hosting Services , all the payment have to make in name of OM Software Internet Solution Pvt. Ltd. payable at Bhopal by either DD or Cheque.
